Terms of Service

1. General

1.1. These Terms of Service govern your use of the app "OshiCal" (hereinafter referred to as "the Service").

1.2. By using the Service, you agree to these terms. If you disagree with any part of the terms, you may not access the Service.

2. User Eligibility

2.1. If you are under 18 years old, you must have your parent or guardian's permission to use the Service.

3. Acceptable Use

3.1. You agree not to:

  • Use the Service for any illegal purposes
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service
  • Harass, abuse, or harm another person
  • Interfere with or disrupt the Service
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
  • Create derivative works based on the Service, or copy, modify, or adapt the Service in whole or in part
  • Use automated scripts, bots, or other means to access the Service or collect data

4. Premium Features

4.1. OshiCal offers premium features through in-app purchases. Premium features include, but are not limited to:

  • Ad-free experience
  • Cross-device data sync via iCloud
  • Other features that may be added in the future

4.2. The availability and scope of premium features may change over time. We reserve the right to modify, add, or remove premium features at our discretion.

5. Subscription Plans

5.1. Available Plans We offer the following premium options:

  • Monthly Subscription: Automatically renewing monthly subscription
  • Yearly Subscription: Automatically renewing yearly subscription (discounted compared to monthly)
  • Lifetime License: One-time purchase providing permanent access (no subscription required)

5.2. Pricing Prices vary by region and are displayed in the App Store and within the app. Prices are subject to change.

5.3. Automatic Renewal

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage your subscription and turn off auto-renewal in your Apple Account settings

5.4. Cancellation

  • You can cancel your subscription at any time through your Apple Account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods
  • You retain premium access until the end of your paid period

5.5. Lifetime License

  • One-time purchase providing permanent access to premium features
  • Non-refundable after purchase (subject to Apple's refund policy)
  • Valid for the lifetime of the app (as long as the app remains available)
  • Includes access to features added after purchase

5.6. Price Changes

  • We reserve the right to change subscription prices at any time
  • Price changes will not affect existing subscribers during their current billing period
  • New prices will apply upon subscription renewal

6. Refunds

6.1. All purchases are processed through Apple's App Store.

6.2. Refund requests must be made through Apple, not directly to us.

6.3. We do not have access to process refunds for App Store purchases.

6.4. Refund eligibility is determined by Apple's policies.

7. Restoration of Purchases

7.1. If you have previously purchased a subscription or lifetime license, you can restore your purchases on any device signed in with the same Apple Account.

7.2. To restore purchases, use the "Restore Purchases" button available in the app's subscription or settings screen.

7.3. Restoration requires an active internet connection and a valid Apple Account that was used for the original purchase.

8. iCloud Data Sync

8.1. Data sync via iCloud is a premium feature and requires an active subscription or lifetime license.

8.2. iCloud sync requires an active iCloud account and sufficient iCloud storage capacity.

8.3. We are not responsible for any failures, interruptions, or data loss related to iCloud services. The availability and reliability of iCloud services are under the control of Apple Inc.

8.4. You are responsible for complying with Apple's iCloud Terms of Service, available at: https://www.apple.com/legal/internet-services/icloud/

8.5. Deleting the app does not automatically delete data stored in iCloud. To delete data stored in iCloud, you must manually remove it from iOS Settings > [Your Name] > iCloud > Manage Storage.

8.6. You are responsible for managing your own iCloud account, including its security, storage capacity, and account settings.

9. Service Discontinuation

9.1. We reserve the right to discontinue or terminate the app at any time, with or without prior notice.

9.2. In the event of app discontinuation:

  • No refunds will be provided for any purchases, including active subscriptions or lifetime licenses
  • We will make reasonable efforts to provide advance notice when possible
  • Users are encouraged to cancel their subscriptions before the app is discontinued

9.3. We shall not be liable for any claims, damages, or disputes arising from the discontinuation of the app or any of its features.

10. Intellectual Property

10.1. The Service and its original content (excluding content provided by users) are and will remain the exclusive property of OshiCal and its licensors.

11. User Content

11.1. Users retain their rights to any content they submit, post or display on or through the Service.

11.2. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute that content.

12. Data Collection and Local Storage

12.1. The Service stores your app usage history primarily on your device.

12.2. For the purpose of improving the Service, anonymized or aggregated usage information may be sent to analytics services. This information does not include data that directly identifies you.

12.3. Deleting the app will permanently remove locally stored data from your device. For data synced to iCloud, please refer to Section 8.

13. Third-Party Services

13.1. The Service may contain links to third-party websites or services that are not owned or controlled by OshiCal.

13.2. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

14. Termination

14.1. We may terminate or suspend your use of the Service immediately, without prior notice or liability, for any reason.

14.2. Upon termination, your right to use the Service will immediately cease.

15. Limitation of Liability

15.1. In no event shall OshiCal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.

16. Changes to Terms

16.1. We reserve the right to modify or replace these terms at any time.

16.2. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

17. Governing Law

17.1. These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes related to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

18. Apple App Store License Terms

18.1. License Grant This application ("App") is licensed, not sold, to you. Your license to the App is subject to your prior acceptance of both these Terms of Service and the Apple Standard End User License Agreement ("Apple Standard EULA"), which is available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

18.2. Acknowledgment You acknowledge that this App is distributed through Apple's App Store and that Apple's Standard EULA applies to your use of the App in addition to these Terms of Service.

18.3. Conflict Resolution In the event of any conflict or inconsistency between these Terms of Service and the Apple Standard EULA, the terms of the Apple Standard EULA shall prevail to the extent of such conflict. All other provisions of these Terms of Service that do not conflict with the Apple Standard EULA shall remain in full force and effect.

18.4. Third-Party Beneficiary Apple and its subsidiaries are third-party beneficiaries of these Terms of Service. Upon your acceptance of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary thereof.

18.5. Scope of License The license granted to you for this App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
